The Elgin City Council has granted preliminary approval for a citywide ban on the sale of synthetically derived THC edibles, citing concerns over child safety, unregulated cannabis products, and marijuana laws. The ordinance, pending final approval, would prohibit the sale, advertisement, and display of Delta-8 and Delta-9 THC edibles, commonly found in vape shops and convenience stores. However, it does not criminalize possession and excludes non-edible THC products such as lotions.
Local officials expressed concerns that these unregulated cannabis edibles closely resemble candy and could appeal to minors. In the absence of statewide cannabis regulations, cities like Elgin, Highland Park, and Waukegan are implementing their own restrictions on hemp-derived cannabinoids and synthetic THC products. Some council members argued for age-restricted sales similar to medical cannabis and recreational marijuana, but the majority supported an outright ban.
As the Illinois cannabis industry grows, this decision could impact businesses selling hemp-derived THC while reinforcing concerns about cannabis product safety and marijuana legislation. A final vote is expected soon, with violations potentially resulting in fines.
